Terms of Service

These terms govern your access to CV Smart Sender and the campaigns you prepare and send through your connected Gmail account.

1. Agreement and eligibility

These Terms of Service form an agreement between you and CV Smart Sender SRL, with its public contact location in Rome, Italy. By creating an account or using the service, you confirm that you have read and accepted these terms, the Privacy Policy, and the Acceptable Use Policy.

You must be at least 18 years old and legally able to enter into this agreement. If you use the service for an organization, you confirm that you have authority to bind that organization.

2. The service

CV Smart Sender helps users prepare individualized email campaigns, add recipients, personalize message fields, attach documents, and send immediately or schedule delivery through a Gmail account the user authorizes. Each delivery is addressed separately and is not sent as CC or BCC to a shared recipient list.

The platform provides campaign controls, delivery states, reusable files, credit accounting, support conversations, and administrative tools. Features may change as we maintain or improve the service. We will not materially expand the use of Google user data without updating our disclosures and obtaining consent where required.

3. Account and Gmail connection

You sign in using a Google identity and may separately connect a Gmail sender. You are responsible for keeping your Google account secure, controlling devices with an active session, and ensuring your profile information remains accurate. You must notify us promptly if you suspect unauthorized access.

CV Smart Sender never asks for your Google password. You may disconnect Gmail at any time in Account settings. Disconnecting prevents future sending, removes the stored authorization token, cancels campaigns that have not begun, and releases unused reserved credits.

4. Credits and additional packs

Signup allocation

A new eligible account ordinarily receives 20 promotional credits. One credit is reserved for each scheduled recipient and is consumed only after the Gmail API accepts a successful send. A reservation is released when a message permanently fails before a successful send or when an unused pending delivery is cancelled.

Additional credit packs may be requested through the platform’s credit or support workflow. Submitting a request does not automatically purchase credits or guarantee approval. The available amount, any price, validity period, payment method, taxes, and pack-specific conditions will be communicated before credits are granted or any payment is due.

Promotional credits have no cash value, are not transferable, and may be limited, corrected, or withdrawn in cases of error, fraud, duplicate accounts, or abuse. Any mandatory refund or consumer right under applicable law remains unaffected.

5. Your responsibilities

You control the recipients, content, attachments, timing, and legal basis for each campaign. You agree to:

  • contact only relevant recipients where you have a lawful and reasonable basis to do so;
  • use accurate sender information and comply with applicable privacy, electronic communication, employment, anti-spam, and consumer laws;
  • honour objections, opt-out requests, and requests from recipients;
  • review recipient addresses, personalization variables, attachments, timezone, and schedule before delivery;
  • avoid purchased, scraped, harvested, guessed, or unlawfully shared recipient lists;
  • comply with Google’s terms, Gmail program policies, sending limits, and account rules.

You retain ownership of content you submit. You grant us a limited, non-exclusive right to host, process, and transmit that content only as needed to operate, secure, and support the service.

6. Prohibited conduct

You may not use the service for spam, phishing, fraud, malware, impersonation, harassment, discrimination, deceptive recruitment, illegal goods or services, credential collection, evasion of provider limits, interference with the service, unauthorized access, or infringement of another person’s rights. Detailed examples and enforcement rules appear in the Acceptable Use Policy.

7. Scheduling and delivery

Scheduled times are interpreted in the timezone selected by the user. The interface shows the current time in that timezone to support review. Internet, database, worker, provider, account, quota, and recipient-server conditions may affect delivery timing.

Google and recipient systems remain independent third parties. We do not guarantee exact delivery time, inbox placement, receipt, opening, reply, employment outcome, or continued availability of any Google API. A successful provider submission does not guarantee that a recipient will accept or read the message.

A campaign may be edited while it is a draft. A scheduled campaign may be rescheduled, paused, or cancelled only before delivery has begun and subject to the controls shown in the platform. Once processing starts, some actions may no longer be available.

8. Support

Support and credit requests may be submitted through the platform and continued in the same conversation thread. Replies appear in the user’s support inbox. You may also contact info@cvsmartsender.com. We do not promise a specific response time unless separately agreed in writing.

9. Suspension and termination

We may limit campaign volume, pause sending, suspend an account, remove credits obtained by fraud, or terminate access when reasonably necessary to protect recipients, the service, Google accounts, provider reputation, or legal compliance. Where appropriate, we may provide notice and an opportunity to explain or correct the issue.

You may stop using the service at any time, disconnect Gmail, or request account deletion. Terms that by their nature should continue—including ownership, accrued obligations, disclaimers, liability limits, and dispute provisions—survive termination.

10. Availability and changes

The service is provided on an “as available” basis. Maintenance, security work, provider changes, force majeure events, or operational incidents may temporarily interrupt access. We may modify or discontinue features and will provide reasonable notice when a material change adversely affects active users, when practicable.

11. Disclaimers and liability

To the maximum extent permitted by law, CV Smart Sender disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages; loss of opportunity, employment, revenue, profit, reputation, or data; recipient decisions; or third-party service failures.

To the maximum extent permitted by law, our aggregate liability arising from the service will not exceed the amount you paid to CV Smart Sender for the service during the 12 months before the event giving rise to the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights or liability for fraud or intentional misconduct.

12. Responsibility for claims

To the extent permitted by applicable law, you are responsible for claims, losses, and reasonable costs resulting from your unlawful campaigns, recipient lists, content, attachments, violation of these terms, or infringement of third-party rights. This provision does not apply to the extent a claim was caused by CV Smart Sender’s own unlawful conduct.

13. Governing law and disputes

These terms are governed by the laws of Morocco, without regard to conflict-of-law rules. Subject to any mandatory right to bring a claim elsewhere, the courts of Casablanca have exclusive jurisdiction. If you are a consumer, mandatory protections and jurisdiction rules in your country of residence remain unaffected.

Before filing a claim, please contact info@cvsmartsender.com so the parties can attempt to resolve the issue informally.

14. General terms

If part of these terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, reorganization, or sale of the service, subject to applicable privacy obligations. These terms, the Privacy Policy, and the Acceptable Use Policy form the entire agreement for the public service unless a separate written agreement applies.
